A Settlement of $345,000,000 has been reached between the Class Plaintiffs and the Pfizer Defendants (which are Pfizer, Inc., Meridian Medical Technologies, Inc., and King Pharmaceuticals LLC (f/k/a King Pharmaceuticals, Inc.)). This Settlement does not concern the resolution of the claims against other defendants in the Action, specifically Mylan N.V., Mylan Specialty L.P., Mylan Pharmaceuticals Inc., Viatris Inc., or Heather Bresch (collectively, the “Mylan Defendants”). Those claims remain pending in the Court and trial of those claims is currently scheduled to commence on January 24, 2022.

UPDATE NOVEMBER 17, 2021:

On November 17, 2021, the Court entered an Order Granting Final Approval of the Settlement, Awarding Attorneys’ Fees, Expenses, and Service Awards, and Approving Plan of Allocation and the Final Judgment and Order of Dismissal with Prejudice Under Fed. R. Civ. P. 54(b) for the Pfizer Defendants Only. Copies of these Orders are available for review on the Court Documents page of this website.

The Settlement Administrator is continuing to process claim forms. Claimants that provided deficient claim forms and/or require additional information to substantiate their claims will be notified in the upcoming weeks. Please note that all claims must be finalized, and the Effective Date for the Settlement must be reached, prior to distribution. Who is Included?

If you are a person or entity in the United States who paid or provided reimbursement for some or all of the purchase price of Branded or authorized generic EpiPens for the purpose of consumption, and not resale, by yourself, your family member(s), insureds, plan participants, employees, or beneficiaries, at any time between August 24, 2011, and November 1, 2020, and did not exclude yourself from the Class during the initial notice period, you are a Class Member. The exceptions to being included in the Class are detailed in the Settlement Agreement.




Your Rights and Options

SUBMIT A PROOF OF CLAIM

This is the only way to be eligible to receive a payment from the Settlement. Proofs of Claim must be postmarked (if mailed) or received (if submitted online) on or before November 12, 2021.

The deadline to submit Proofs of Claim has passed.


OBJECT TO THE SETTLEMENT BY SUBMITTING A WRITTEN OBJECTION

Write to the Court and explain why you do not like the Settlement, the Plan of Allocation, and/or the request for attorneys’ fees, expenses, or service awards. Objections must be filed with the Court and received by the parties on or before September 24, 2021.

The deadline to submit an objection has passed.


ATTEND THE FAIRNESS HEARING ON OCTOBER 27, 2021 AT 9:00 A.M. CENTRAL, AND FILE A NOTICE OF INTENTION TO APPEAR

Ask to speak in Court about the fairness of the Settlement. Requests to speak must be filed with the Court and served on the parties on or before September 24, 2021. If you submit a written objection, you may (but you do not have to) attend the hearing.

The deadline to file a Notice of Intention to Appear has passed.


DO NOTHING

Receive no payment. You will, however, still be a Class Member, which means that you give up your right to ever be part of any other lawsuit against the Pfizer Defendants about the legal claims being resolved by this Settlement and you will be bound by any judgments or orders entered by the Court in the Action.
